  1. Terms and conditions for the use of our websites and materials

This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the materials listed on our websites (“our sites”) to you. Please read these terms and conditions carefully before accessing any of these materials on our sites. You should understand that by accessing or using any of these materials, you agree to be bound by these terms and conditions. If you do not agree to these terms of use, please refrain from using our sites.

We may change these terms at any time without notice. We recommend you check this page from time to time to take notice of any changes made.

  1. Information about us

This Superfast Business Cornwall site is being delivered by Serco Employment, Skills and Enterprise.  We deliver this Service under the legal entity of Serco Regional Services Limited (“SRS”), a company registered in England and Wales (Registered No. 01653016).  Registered Office: Serco House, 16 Bartley Wood Business Park, Bartley Way, Hook, Hampshire RG27 9UY. SRS is a wholly owned subsidiary of Serco Group plc.  References to “we” or “us” mean Serco Employment, Skills and Enterprise, SRS or Serco Group plc.

We operate this website and collect and process data you provide when you submit information via this website. We process any personal information collected about you through your use of our websites, e.g. when registering your details online for services, in accordance with our Privacy Policy.

  1. Access to our sites

Access to our sites is permitted on a temporary basis, and we reserve the right to withdraw or amend the service and information we provide on our sites without notice. We will not be liable if for any reason our sites are unavailable at any time or for any period.  From time to time, we may restrict access to some parts of our sites, or to the entirety of our sites, to users who have registered with us.

If you choose, or you are provided with a password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any passwords, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.

You are responsible for making all arrangements necessary for you to have access to our sites. You are also responsible for ensuring that all persons who access our sites through your internet connection are aware of these terms, and that they comply with them.

  1. Information collected when you use our websites

When you visit our websites we may collect information about your computer, including where available your Internet Protocol (IP) address, operating system, and browser type.

We may also collect and process information about the resources you access and which web-based tools and business support services you use.

We use a third party service, such as Google Analytics, to do this. We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify anyone. We do not make, and do not allow Google to make, any attempt to find out the identities of those visiting our website. If we do want to collect personally identifiable information through our website, we will be up front about this.  We will make it clear when we collect personal information and will explain what we intend to do with it.

Our websites use cookies – small text files that are placed on your computer or smartphone by the websites that you visit. 6.5. to restrict access and use of these materials only to your employees, directors, officers, or agents who agree to abide by the terms of these terms and conditions;

6.6. not to make any of these materials available to any third parties;

6.7. that we may terminate your access to and right to use these materials at any time and that, if this occurs you will stop using these materials and immediately return them to us at your own expense (including any copies made), or immediately destroy such materials if we request you to do so. In addition any third party referred to in paragraph 7 below shall have the right to require you to return or destroy these materials to them directly.

  1. Intellectual Property Rights

All the materials published on our sites are protected by, and subject to, copyright and other relevant intellectual property rights and are owned by us and various third parties who have licensed their use to us under strict licensing arrangements.  If you use these materials in a manner or for a purpose not authorised under these terms and conditions, you may be liable to these third parties for infringement of their intellectual property rights.  We accept no responsibility, and will not be liable for, any actions by you that result in any such infringement claim.

  1. Our Liability

The material displayed on our sites is provided without any guarantees, conditions or warranties as to its accuracy. We aim to update our sites regularly and may change the content at any time.  Any of the material on our sites may be out of date at any given time, and we are under no obligation to update such material.

To the extent permitted by law, we and third parties connected to us hereby expressly exclude:

  • All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity
  • Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our sites or in connection with the use, inability to use, or results of the use of our sites, any websites linked to it and any materials posted on it, including, without limitation any liability for loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable, provided that this condition shall not prevent claims for loss of or damage to your tangible property or any other claims for direct financial loss that are not excluded by any of the categories set out above.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Commentary and other information posted on our sites are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our sites, or by anyone who may be informed of any of its contents.

You must not attempt to gain unauthorised access to our sites, the server on which our site are stored or any server, computer or database connected to our sites. You must not attack our sites via a denial-of-service attack or a distributed denial-of service attack.

By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our sites will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our sites or to your downloading of any material posted on it, or on any website linked to it.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our sites must not be framed on any other site, nor may you create a link to any part of our sites other than the home pages, without our prior consent (not to be unreasonably withheld or delayed). We reserve the right to withdraw linking permission without notice.

14.2. Any dispute arising out of or in connection with these terms and conditions shall be subject to the non-Exclusive jurisdiction of England and Wales.
